Policy Q&A of the State Administration of Foreign Exchange on Some Foreign Exchange Management Business

For the purposes of making the public more accessible to foreign exchange management policies and regulations and promoting trade and investment facilitation, further explanations have been presented as follows in relation to the policies and issues about foreign exchange management in practice some banking enterprises have recently proposed: 为便利社会公众了解外汇管理政策法规,促进贸易投资便利化,针对实践中部分银行企业近期提出的外汇管理政策问题,进一步说明如下:
1. Q: Can eligible non-bank financial institutions participate in the inter-bank foreign exchange market?   1.问:符合条件的非银行金融机构是否可参与银行间外汇市场交易?
A: In accordance with the provisions of the Notice of the State Administration of Foreign Exchange on Adjusting Policies Related to the Administration of Financial Institutions' Access to the Inter-Bank Foreign Exchange Market (No. 48 [2014] of the State Administration of Foreign Exchange), a domestic financial institution qualified to conduct the spot foreign exchange settlement and sale business with the approval of the State Administration of Foreign Exchange (“SAFE”) and qualified to conduct the derivatives trading business with the approval of the relevant financial regulatory authority may become a member of the inter-bank foreign exchange market if it complies with the technical specifications for the relevant business in the inter-bank foreign exchange market, and conduct the corresponding RMB-foreign exchange spot and derivative transactions. The SAFE shall no longer implement the prior licensing for access to the inter-bank foreign exchange market. Therefore, eligible non-bank financial institutions may participate in the inter-bank foreign exchange market transactions after meeting certain conditions. 答:根据《国家外汇管理局关于调整金融机构进入银行间外汇市场有关管理政策的通知》(汇发〔2014〕48号)规定,境内金融机构经国家外汇管理局批准取得即期结售汇业务资格和相关金融监管部门批准取得衍生品交易业务资格后,在满足银行间外汇市场相关业务技术规范条件下,可以成为银行间外汇市场会员,相应开展人民币对外汇即期和衍生产品交易,国家外汇管理局不实施银行间外汇市场事前入市资格许可。因此,符合条件的非银行金融机构,在满足一定条件后可以参与银行间外汇市场交易。
2. Q: Whether cross-border e-commerce enterprises can handle cross-border foreign exchange receipts and payments under trade in goods and foreign exchange settlement and sale in banks by virtue of sales orders and logistics and other information obtained through “single window” or cross-border e-commerce public service platform? 2.问:跨境电商企业是否可凭“单一窗口”或跨境电商公共服务平台等获取的销售订单、物流等信息,在银行办理货物贸易跨境收付及结售汇业务?
...... 答:根据《国家外汇管理局关于规范货物贸易外汇收支电子单证审核的通知》(汇发〔2016〕25号)规定“银行按照‘了解客户、了解业务、尽职审查'的展业原则和现行货物贸易外汇管理规定,为符合条件的企业办理货物贸易外汇收支业务时,可以审核其纸质单证,也可以审核电子单证。电子单证是指企业提供的符合现行法律法规规定,且被银行认可并可以留存的电子形式的合同、发票、报关单、运输单证等有效凭证和商业单据,其形式包括系统自动生成的电子单证、纸质单证电子扫描件等”。上述通知同时明确了使用电子单证办理货物贸易外汇收支的银行和企业的条件,自由贸易试验区内进一步放宽了银企准入条件。
